Criminal Consequences Possible for Teens Who Post Beatings Online

Former Solicitor David Schwacke says when it comes to kids beating up other kids and recording it for the internet, there are severe consequences...even if they are juveniles.

Schwacke says crimes like these are often taken out of family court, so the perpetrators can be tried as adults.

"If there are certain factors the judge has found out ..that family court judge could send them up to be tried as an adult", Schwacke said.

And that means possibly facing charges of assault and battery of a high and aggravated nature, charges of lynching, and charges of kidnapping.
If convicted, each of those charges could add 20 to 30 years behind bars- with no parole.

Schwacke says the fact that these kids are recording these beatings on camera or cell phones is actually doing a favor for the prosecution by showing exactly what happened from start to finish and helping prove intent.

"At that point you just have to prove the identity is the one you have on trial and hit play and essentially you'll have a conviction", Schwacke said.
