CHARLESTON, S.C. (AP) - State agencies are asking a federal judge to dismiss North Charleston's lawsuit over plans for rail access to ports facilities.
The commerce department and its division of public railways filed the request last week.
North Charleston has sued to block the state's plan to provide rail service to a new container port from the north end of the old Navy base. The rail line would run through neighborhoods North Charleston is working to redevelop. The city wants the rail access from the southern side of the property.
The state's "dual access" plan is designed to assure that both Norfolk Southern and CSX railroads have competitive access to the new terminal.
An attorney for the city called the state request routine.
