The East Texas dentist accused of killing his wife is back behind bars.

According to sources, Nichols was in possession of alcohol, which is a violation of his bond condition.

76-year-old Bobby Ray Nichols was arrested and booked into the Smith County Jail around 1:30 am on Sunday.

According to Tucker's Beverage in Winona, Nichols bought a half-gallon of vodka and a liter of whiskey. Tucker's staff then notified the Smith County District Attorney's Office of the purchase.

The arrest is not in connection with any previous bond hearings.

In a hearing on January 14, the State asked that Nichols' bond be raised and the conditions of his bond be revoked because Nichols allegedly possessed alcohol while on bond, which is a violation of the terms of his bond. The judge, at the time, said he did not want to do anything that will impair the defense's ability to prepare for trial.

On the evening of January 17, prosecutors rested their case in the death of 71-year-old Rosalind Nichols, his wife of 26 years. The defense will begin presenting its case on the morning of January 23 after a long weekend to mark the Martin Luther King Jr. holiday.

Nichols previously admitted to shooting his wife on the night of June 29, 2012, after a heated argument at their Tyler home.

If convicted, Nichols could be sentenced to up to life in prison.
