Live 5 Most Wanted fugitive back in jail after mistaken release

ORANGEBURG COUNTY, SC (WCSC) -

One of Live 5's Most Wanted fugitives is back in the Orangeburg County jail after he was mistakenly released over the weekend following a DUI arrest.

Thomas David Poston, 61, apparently gave authorities a phony name and a different birth date after being arrested for driving under the influence.  As a result, he was released hours later despite the fact he was supposed to have been held because of charges from North Charleston police.

According to authorities, Poston told state troopers his name was Johnny Timothy Poston and said he was 64 years old during his arrest in Orangeburg County early Sunday morning.

Poston was freed from the Orangeburg Calhoun jail after posting a $100 bond. North Charleston cops want Poston on a charge of swindling.

Investigators say Poston took more than $14,000 from the family of a former fellow prison inmate, claiming he was working with an attorney to get the inmate released after serving only 14 years of a 30 year prison sentence.
