SUMMMERVILLE, SC (WCSC) - South Carolina Department of Revenue investigators arrested a Summerville man Thursday accused of withholding income tax he took from employees.
DOR spokeswoman Samantha Cheek said investigators arrested 50-year-old Timothy Spivey and charged him with nine counts of failure to properly collect withholding tax.
Investigators say Spivey, a former owner and operator of two construction site cleanup services, deducted and collected state income tax from employee wages, but failed to remit income tax payments to the DOR.
On behalf of the former companies, Spivey failed to file necessary tax returns and truthfully account for state income taxes withheld in the amount of $153,643.64 for tax years 2004 through 2010, according to Cheek.
If convicted of the charges, Timothy Spivey could face up to $90,000 in fines and up to 45 years in prison.
