JAMES ISLAND, SC (WCSC) - The Charleston Police Department arrested a teen Wednesday accused of raping a 12-year-old girl after plying her with Four Loko last fall.
Police say the investigation began in early January, when the school resource officer at James Island Middle School spoke with the victim, who said Joseph Bailey, now 17, performed sex acts on her without her consent.
According to court documents, the victim said she and Bailey were at a recreation room at an apartment complex located in the 1400 block of Camp Road. She couldn't remember exactly when the assault happened, but said it took place sometime between Nov. 18 and Nov. 22.
The victim told investigators Bailey gave her Four Loko beverages until she became intoxicated and could not leave, as she was "unable to walk away due to the unsteadiness of her body," an affidavit states.
She said Bailey began taking her clothes off and touching her in private areas, at which time she said "No" and told him to stop, but he continued before eventually forcing sexual intercourse. The victim said she was unable to push Bailey off of her due to her "significant level of intoxication," according to court documents.
Bailey is being held in the Charleston County Detention Center on a charge of second-degree criminal sexual conduct with a minor.
He is expected in bond court on Thursday.
