Baby Veronica's biological father files second appeal with OK Supreme Court

OKLAHOMA CITY (KOTV/WCSC) - Dusten Brown, the biological father of Baby Veronica, has filed a second appeal with the Oklahoma Supreme Court, according to media reports in Tulsa.

Tulsa World is reporting that Brown has filed the appeal in order to block orders that he give his girl to her adoptive parents, Matt and Melanie Capobianco of James Island.

Brown was already in the process of appealing a Nowata County decision to give Veronica to the Capobiancos.

According to Tulsa World, Brown is now appealing a similar order from Muskogee County.

The news falls on the heels of Oklahoma Governor Mary Fallin speaking publicly for the first time about the case. She says she gave Brown an opportunity to work out an arrangement with the Capobiancos and agree on what's best for Veronica.

Earlier this week, she signed an extradition order for Brown to return to South Carolina, where he's charged with custodial inference. She says now we must wait.

"It happened for a while and then it stopped, and so now it's been almost a month and we expect some progress to be made," Fallin said."But unfortunately that progress has stopped.. It's unfortunate, but now it's in the courts hands, so we'll have to wait and see what the court does."

Despite the signature by the governor, an Oklahoma judge will decide whether or not to send Brown to South Carolina.
