BERKELEY COUNTY, SC (WCSC) - A Moncks Corner man surrendered to authorities Wednesday after being accused of inappropriately touching a child.
Michael Smart faces a charge of third degree criminal sexual conduct, according to Berkeley County authorities.
The charge follows an investigation into an March, 2012 incident.
According to an incident report, the mother of the victim told deputies her daughter returned from a friend's home. The child told her mother that while there, she went to the kitchen to throw something away and the friend's dad, identified as Smart, was standing at the kitchen sink and reached up and put his hand up the child's shorts, the report states.
The victim told her mother when she pulled his hand away, he made "an exasperated breath" and walked away, the report states.
Smart was previously charged with criminal sexual conduct with a minor in November, 2015 for a second incident authorities say occurred in May, 2013.
In that incident, the victim's father told deputies his daughter told him that during a sleepover with friends at Smart's home, Smart fondled her, the report states. Deputies say the child victim said Smart made her perform sex acts and said she would not get food or water until she had done so. The child said none of the other children or or his wife knew what had taken place, the report states. The victim was between five and six years old at the time of that incident, deputies say.
Isle of Palms Fire Chief Ann Graham confirmed Smart was a former firefighter with the department but is no longer employed there.
