NORTH CHARLESTON (WCSC) - The death of an employee of the South Carolina Ports Authority is being investigated as a criminal act, according to court documents filed by the SPA.
Documents filed by the victim's wife and the SPA say Derek Boyd died in an accident at the Port of Charleston on December 11, 2015.
On Feb 26, 2016, in response to being accused of negligence by Boyd's wife, the SPA said they were turning their investigation over to North Charleston police because the case's information and evidence may be "criminal in nature."
On Wednesday, the SPA asked a judge to dismiss the accusation of negligence, saying the victim's wife failed to provide sufficient evidence of her claim.
A report by the North Charleston Police Department states the department's traffic unit was requested to assist the State Port Authority PD with a fatality that happened on their property.
When officers arrived they learned that the victim had been working to secure his container to the chassis when for an "unknown reason" he made contact with another truck and sustained head injuries. Police say that truck then left the scene.
Police say the victim was transported to MUSC where he died.
