Murder charges dismissed in Read St. shooting

CHARLESTON, SC (WCSC) -

Two men charged with murder in a shooting that took place on Read Street earlier this year have had the charge against them dismissed. 

The solicitor's office dismissed the murder charge against 16 year old Marcus Spann and co-defendant 26 year old Deantre Maybank. 

According to court records, they were dismissed May 27 along with the kidnapping charge against Maybank.

Court papers originally stated the 16-year-old and other suspects ransacked the victim's apartment after binding the his hands and feet. Investigators say the victim, later identified as 42-year-old Draco Istan Ali Ben Walker, was shot once inside the apartment before freeing one hand and managing to make it outside. They say he was then shot several times more outside of the apartment.

Maybank is still in custody because of several other charges. 

The murder is still under investigation.
