Dorchester County jury awards Summerville driver $1.25 million after tree fell on car

SUMMERVILLE, SC (WCSC) -

A Dorchester County jury recently said a driver in Summerville was owed $1.25 million for an incident which occurred on West Carolina Avenue in 2015. 

Donald Gamble was driving on the Summerville road when a large tree on David Beal's property fell on his vehicle, according to the initial lawsuit. Gamble needed a spinal fusion surgery, the lawsuit said. 

Gamble claimed that Beal had a "duty" to maintain his land and not endanger citizens and Beal should have known the tree was dangerous prior to the accident. 

The lawsuit was filed in June 2016, more than a year after the accident. Auto-Owners Insurance Company paid Gamble the money as well as an additional $38,356 in prejudgement interests on March 1 after a verdict on Feb. 23.
