Jury: N. Charleston PD 'grossly negligent' in 2013 apartment home search

NORTH CHARLESTON (WCSC) - A Charleston County jury sided with a couple in a case stemming from a North Charleston police search in 2013.

The initial complaint stated that the North Charleston police searched April Zealous and Gary McDaniels' apartment home in April 2013 looking for a suspect they thought was hiding in an adjacent apartment. Authorities went into the attic because the space was shared with the next apartment over.

The suspect wasn't located, according to the initial complaint, but the couple alleged the department was "grossly negligent" in their search claiming items were "unnecessarily damaged or destroyed."

The jury said the couple's claim that their fourth amendment rights were violated was unfounded, but agreed with the claim of gross negligence and awarded the couple $25,000.
