Smith's brother, Bryant Smith, was arrested at 9 a.m. Saturday on murder charges related to the same incident.
Charleston Police were called to a parking lot on Reid Street near East Bay Street at 11:40 a.m. on April 18. On arrival, they found two men inside a vehicle who had been shot, according to a police report.
The victims were taken to the hospital, where 27-year-old George Bennett died.
Police say the other victim, who was holding a toddler when he was shot, had non-life threatening injuries. That victim has since been released from the hospital.
